Trivia Licensing

Trivia Database licenses selected database content (questions and/or factoids) for your online and offline project needs. Our full-use-license allows you to use the trivia in any online or offline game or project. The licensing fee is a one-time charge per trivia question/factoid based on the quantity and specific requirements of your order.

Our full-use-license is required for game developers, web site owners, board game producers, publishers and anyone who intends to reproduce the questions/factoids as part of a game or presentation for distribution.

Our standard trivia questions/factoids are drawn from our extensive database. Each question has one correct and three incorrect answers. Each question will have a unique question/factoid number identifying it in our database. Trivia questions/factoids are chosen based on your requirements from the categories you select. We deliver the questions/factoids via electronic means, either email or download.

We can work from a full agreement provided by the Licensee or we will include license language in the invoicing, or email similar to the sample below. By purchasing trivia content the licensee agrees to the terms provided below unless otherwise indicated in a separate signed agreement.

All transactions are covered by the below unless otherwise agreed in writing:

License and Proprietary Rights.

a) Trivia Questions/Factoids License. In return for payment in full stated and agreed upon, Trivia Company (WMSI) hereby grants to licensee a perpetual license to use, edit, modify, reproduce, license, publish, distribute, transmit, broadcast, or publicly exhibit, display, perform or digitally perform the Trivia questions/factoids in connection with the licensee's Service and Games for entertainment purposes.

b) Company Proprietary Rights. Licensee acknowledges and agrees that, except for the Trivia License, Trivia Company (WMSI) owns and shall retain all rights, title and interest in and to the Trivia questions/factoids, including, without limitation, all copies thereof and other intellectual property rights inherent therein and appurtenant thereto.

c) No Exclusivity. It is expressly understood and agreed that this Agreement does not grant Licensee any exclusive rights and Trivia Company (WMSI) may contract, without restrictions, with other persons or entities for the sale of products and/or services similar to or exactly like the products and/or services provided by Company hereunder.

d) Licensee may distribute the Trivia questions/factoids on the licensee's Service, as determined in the sole and exclusive discretion of licensee subject to the terms and conditions of this Agreement. Licensee acknowledges and agrees that licensee may NOT redistribute, rebundle or resell either for fee or no fee the Trivia questions/factoids as stand-alone content separate from licensee game and or service to any and all third parties. .

e) Disclaimer of Warranty. Except as specified, neither party makes any warranty in connection with the subject matter of an agreement or license purchase and hereby disclaims any and all implied warranties, including all warranties of merchantability and fitness for a particular purpose regarding such subject matter.

We fully understand the importance of giving our customers the right content for their needs, we will work with you to make sure the trivia you get is the best match for the audience you intend to reach. When additional questions/factoids are purchased from us in the future we guarantee that the new questions will not be in previous delivered files. Our pricing is per question and/or factoid and based solely on quantity and options needed.
